Additional Resources
The following resources include additional information pertinent to the Housing Credit Program.
- IRS Notice 2008-106 (16 KB Adobe PDF File)
In an effort to address the confusion created by the language in the Housing and Economic Recovery Act (HERA), the IRS issued Notice 2008-106 on November 13, 2008. In the Notice, the IRS concluded that the 9 percent credit rate will apply to projects during the timeframe stated in the HERA, even if a previous credit rate lock-in agreement exists. Therefore, OHFA will assign the 9 percent credit rate to all non-federally subsidized new construction or rehabilitation buildings placed in service after July 30, 2008. Owners and accountants should be aware of this IRS Notice as they prepare requests for 8609 Forms. The higher credit rate does not mean the buildings will automatically receive more housing tax credits. The credits must be allocated by OHFA through the process described in the Qualified Allocation Plan. Please note that the credit rate will revert to a floating rate for buildings placed in service after December 31, 2013. - Market Information for the Housing Credit Program
